Erving Goffman’s “Asylums” is a key text in the development of contemporary, community-orientated mental health practice. It has survived as a trenchant critique of the asylum as total institution, and its publication in 1961 in book form marked a further stage in the discrediting of the asylum model of mental health care. In this paper, some responses from a range of disciplines to this text, 50 years on, are presented. A consultant psychiatrist with a special interest in cultural psychiatry and (...) mental health legislation, two collaborating psychotherapists in adult and forensic mental health, a philosopher, and a recent medical graduate, present their varying responses to the text. The editors present these with the hope of encouraging further dialogue and debate from service users, carers, clinicians, and academics and researchers across a range of disciplines. (shrink)

The aim of this study was interpret the existential construct of family caring following Acute Coronary Syndrome. Family support is known to have a positive impact on recovery and adjustment after cardiac events. Few studies provide philosophically-based, interpretative explorations of carer experience following a spouse’s ischaemic event. As carer experiences, behaviours and meaning-making may impact on the quality of the support they provide to patients, further understanding could improve both patient outcomes and family experience. Fourteen spouses of people experiencing Acute (...) Coronary Syndrome in Sydney, Australia were engaged in a single, semi-structured interview. Interviews were audio-recorded and transcribed verbatim. Data were analysed using hermeneutic interpretation within a Heideggerian phenomenological framework. Acute Coronary Syndrome disrupts lived temporality, and the projected potential for carers’ being-alongside. Carers experienced an existential uncertainty that arose from difficulty in diagnosis, and situated fear as an attuned, being-towards-death. They constructed protective strategies to insulate their partner and themselves from further stress and risk, however, unclear boundaries for protection heightened carer anxiety. The existential structure of care included one of two possible Heideggerian modes: leaping-in care was a dominating mode that required a high level of carer vigilance; leaping-ahead care was a metaphorical walking alongside, as carers gave back control, freeing opportunities for the person to ‘own’ care. Supporting carers through the intensive phase of leaping-in care, and equipping them for informed leaping-ahead care should be a focus in both the acute and post-discharge care phases. (shrink)

The essays in this collection, many originally presented at a 2008 colloquium on Celtic Cosmology and the Power of Words, aim to examine the worldviews held by the Celtic peoples, particularly the Gaelic (Irish and Scottish) perspectives. Texts and inscriptions, some of them pre-Christian, in Celtic languages and in Celtic Latin provide the sources for the worldviews under study. This area of research is also linked to that of the power of words, which refers to human belief in powerful speech (...) acts. Naming and story-telling processes convey knowledge of the cosmos; this knowledge is connected to the landscape and its roads, rivers, mountains and hills. Cosmology is a description of the order and structure of the world as perceived by human beings, and its study is a study of layers – in the earth, in the language and in the tales. (shrink)

One aspiration of an analytic jurisprudential theory is to provide an account of how legal obligations arise, including the legal obligation of judges to apply only legally valid norms when adjudicating cases. Also, any fully adequate theory should enable a solution to a ‘chicken-egg’ puzzle regarding legal authority: legal authority can exist only in virtue of rules that authorize it, but such rules require a legal authority as their source. Which came first? This article argues that it is difficult to (...) see how a particular type of positivist theory (featuring a fundamental norm that plays certain roles) can solve the puzzle and also account for the aforementioned adjudicative duty. The challenge can be framed in terms of the need to be able to derive a legal ‘ought’ (applying to courts) from only ‘is’-statements expressing social facts, where the requisite derivation cannot rely on what John Searle has called ‘institutional facts’. This article addresses some useful coordinates for the analysis of the relationship between philosophy and taxation. My argument aims to show the relevance of a philosophy of taxation and thus draw attention to civic education required to shape a democratic public reason, truthful, critical and attentive. I emphasize the character of “donation” that is the rule of law within a democratic constitutional regime, which depends on tax payments for the purposes proposed, and particularly those of a social distributive justice. I (...) distinguish between charity and justice and political obligation to maintain that by implementing an effective "rule of law" citizens “donate” ourselves mechanisms and procedures for advancing a system of justice as fairness. This grant does not pertain to the field of natural duties, charity or sacrifice of supererogatory acts, but is expressed in institutional programs whose implementation and maintenance required from us pay taxes, but always based on personal commitment. According to the new family of theories that emerged around the second half of the nineteenth century, time is more similar to space than it had been construed to be under the previous family of theories. These new theories of time treat time as being a “fourth dimension” that is much more like the three spatial dimensions than it was imagined to be under the older rival theories. Over the two centuries following Newton, the key concepts of graphs and the (...) differential and integral calculus, trickled out into a wide intellectual community. Mc Taggart's theorem purports to be a disproof of all the old theories of time – on the grounds that they are logically inconsistent. When John Duns Scotus died at the young age of 42, seven centuries ago in 1308, he did not leave behind a completed body of work which would present his mature philosophical thought. Thus, the followers of Scotus were faced with the challenging task of interpreting the texts of the Subtle Docotr. Since Scotism became one of the most important schools of thought by the early modern period, the synthesis elaborated by the most famous of the commentators on Scotus’s (...) philosophy Hugo Cavellus (1571-1626), Irish Franciscan and Archbishop of Armagh is of capital importance. Cavellus dedicated a considerable part of his commentary on the De Anima of Duns Scotus to the problems relating to the theory of the knowledge. Because of Cavellus’s central importance in seventeenth-century Scotism, his writings on doubt, evidence and certitude are noteworthy in terms of developments in modern thought. (shrink)

According to the cognitive penetrability hypothesis, our beliefs, desires, and possibly our emotions literally affect how we see the world. This book elucidates the nature of the cognitive penetrability and impenetrability hypotheses, assesses their plausibility, and explores their philosophical consequences. It connects the topic's multiple strands (the psychological findings, computationalist background, epistemological consequences of cognitive architecture, and recent philosophical developments) at a time when the outcome of many philosophical debates depends on knowing whether and how cognitive states can influence perception. In a world plagued by disagreement and conflict one might expect that the exact sciences of logic and mathematics would provide a safe harbor. In fact these disciplines are rife with internal divisions between different, often incompatible, systems. Do these disagreements admit of resolution? Can such resolution be achieved without disturbing assumptions that the theorems of logic and mathematics state objective truths about the real world? In this original and historically rich book John Woods explores apparently intractable disagreements in (...) logic and the foundations of mathematics and sets out conflict resolution strategies that evade or disarm these stalemates. In the present discussion, I delve into the world of literature and explore Viaje a caballo por las provincias Argentinas [Journey (...) on horseback across the provinces of Argentine] a work originally written by William Mac Cann, a British businessman who visited the country between 1947 and 1948. His observations not only reveal the collective patterns of behaviour that have remained part of daily life up to date. The volume describes the attempts of an elite interested in creating a united, but subordinated, image of society, and illuminates the diverse mechanisms of imperial expansion. Hospitality plays a crucial role in the hierarchy of travellers presented in the book, with some belonging to the higher classes of society and others unnamed. (shrink)

This book collects John Gardner's celebrated essays on the theory of private law, alongside two new essays. Together they range across the central puzzles in understanding the significance of outcomes, the role of justice in private law, strict liability, the reasonable person standard, and the role of public policy in tort law.

For scientific knowledge to be trustworthy, it needs to be dissociated from material interests. Disinterested research also performs other important non-instrumental roles. In particular, academic science has traditionally provided society with reliable, imaginative public knowledge and independent, self-critical expertise. But this type of science is not compatible with the practice of instrumental research, which is typically proprietary, prosaic, pragmatic and partisan. With ever-increasing dependence on commercial or state funding, all modes of knowledge production are merging into a new, ‘post-academic’ research (...) culture which is dominated by utilitarian goals. John Passmore was a renowned Australian empirical philosopher and historian of ideas. In this book, which was originally published in 1952, Passmore's intention was to disentangle certain main themes in Hume's philosophy and to show how they relate to Hume's main philosophic purpose. Rather than offering a detailed commentary, the text provides an account based on specificity and critical scholarship, seeking to complement the other more comprehensive works on Hume's philosophy that had become available around the same time. Two reports have shown that mammalian artificial chromosomes (MAC) can be constructed from cloned human centromere DNA and telomere repeats, proving the principle that chromosomes can form from naked DNA molecules transfected into human cells. The MACs were mitotically stable, low copy number and bound antibodies associated with active centromeres. As a step toward second-generation MACs, yeast and bacterial cloning systems will have to be adapted to achieve large MAC constructs having a centromere, two telomeres, and genomic copies of mammalian (...) genes. Available construction techniques are discussed along with a new P1 artificial chromosome (PAC)-derived telomere vector (pTAT) that can be joined to other PACs in vitro, avoiding a cloning step during which large repetitive arrays often rearrange. The PAC system can be used as a route to further define the optimal DNA elements required for efficient MAC formation, to investigate the expression of genes on MACs, and possibly to develop efficient MAC-delivery protocols. Abstract:Can a war can be just on both sides? Within the Western just war tradition, Catholic theologians traditionally held wars on both sides to be logically impossible. This view went unchallenged until questioned by two seventeenth-century Irish Franciscan Scotists. These were Aodh Mac Cathmhaoil (Hugo Cavellus) and John Punch. In this paper I lay out the Scotist theological grounds that led them to admit to the possibility of wars just on both sides. I also conjecture on possible reasons why (...) The presence of a kinship link between nuclear families is the strongest predictor of interhousehold sharing in an indigenous, predominantly Dolgan food-sharing network in northern Russia. Attributes such as the summed number of hunters in paired households also account for much of the variation in sharing between nuclear families. Differences in the number of hunters in partner households, as well as proximity and producer/consumer ratios of households, were investigated with regard to cost-benefit models. The subset of households involved in reciprocal (...) meal sharing is 26 of 84 household host-guest pairs. The frequency of reciprocal meal sharing between families in this subset is positively correlated with average household relatedness. The evolution of cooperation through clustering may illuminate the relationship between kinship and reciprocity at this most intimate level of food sharing. (shrink)

This book provides an intellectual biography of Max Horkheimer during the early and middle phases of his life and analyzes his model of early Critical Theory.

Modularity is a fundamental doctrine in the cognitive sciences. It holds a preeminent position in cognitive psychology and generative linguistics, as well as a long history in neurophysiology, with roots going all the way back to the early nineteenth century. But a mature field of neuroscience is a comparatively recent phenomenon and has challenged orthodox conceptions of the modular mind. One way of accommodating modularity within the new framework suggested by these developments is to go for increasingly soft versions of (...) modularity. One such version, which I call the “system” view, is so soft that it promises to meet practically any challenge neuroscience can throw at it. In this paper, I reconsider afresh what we ought to regard as the sine qua non of modularity and offer a few arguments against the view that an insipid “system” module could be the legitimate successor of the traditional notion. John Collins defends the doctrine of linguistic pragmatism--arguing that linguistic meaning alone fails to fix truth conditions and detailing the relative sparseness of what language alone can provide to semantic interpretation--through his novel analysis of the syntax, semantics, and pragmatics of weather reporting.

I was in manufacturing for over thirty years and a manager for nearly twenty-five. During that time it never occurred to me that the consequentialist, utilitarian framework I used was inadequate as a conceptual framework for making decisions to ensure organisational viability and success.1 The framework gave three criteria which enabled me to construct a rational approach to issues associated with my role as a manager: To show that this framework is adequate as a basis for managerial decision making I (...) want to spell out the logical implications of the three criteria and show that they are necessary and jointly sufficient to provide an epistemically sound framework for managerial decisions. I will argue that we can look to managerial practice for examples which can serve as paradigms for constructing a pragmatic approach to management decision making, one that — when employed correctly — will result in the best moral outcome for all those affected by a decision.2 This approach is derived from, and ultimately justified by, the primary role responsibility of a manager to create and implement a healthy work environment. This is one designed to be viable so that the organisation can compete successfully in the marketplace and meet the morally minimal standard that we ought not to cause unnecessary and avoidable harm to innocent people. Because the approach is goal directed, it is teleological and consequential in nature. I maintain that a workplace, or organisation, is healthy when all the components that constitute it are working coherently together to achieve legitimate organisational goals designed to ensure the best chances of being viable and competitive. Sadler suggests irrationality may be the key to distinguishing psychiatric from nonpsychiatric violence. We are not so sure that this is necessarily as helpful as it might at first seem. Who gets to decide what is rational? Much (...) “normal” violence, committed in the heat of the moment, impulsively, and drunkenly, may not appear that rational, even to the perpetrator, in the cold light of day. We are not sure one would wish to bring this sort of violence within the province of psychiatric explanations. Likewise, a point we made in our paper: Even delusionally driven violence often has its own internal coherence and rationality within an irrational framework.We found much to agree with in McCallum’s commentary, and perhaps his alternative approach is more helpful. He proposes a more sociological model of understanding what is going on in these complex cases, one that starts with societal dividing practices. Our present times have been described as the tyranny of the bureaucrats. Professional approaches are devalued. Diagnosis is only relevant in terms of its bureaucratic utility in moving people from one category to another. Since the writing of our paper, the criminal law has changed further in England and Wales. The Criminal Justice Act 2003 brought with it new sentences of indeterminate detention for public protection for those offenders categorized as “dangerous.” The presence or absence of psychiatric disorder being largely irrelevant for these purposes. This would seem to fit nicely with McCallum’s analysis, and in principle rather takes the wind out of our sails when we argued about the discrimination against psychiatric violence—now a diagnosis is not necessary for the state to intervene in a probabilistic fashion to prevent future violence. Deciding between what sort of violence counts as psychiatric and what does not, does not have quite the same drastic differential effect on the individual as perhaps it did. Evidence of the pervasiveness of neural reuse in the human brain has forced a revision of the standard conception of modularity in the cognitive sciences. One persistent line of argument against such revision, however, cites the evidence of cognitive dissociations. While this article takes the dissociations seriously, it contends that the traditional modular account is not the best explanation. The key to the puzzle is neural redundancy. Western thought since the seventeenth century has been dominated by methodological solipsism (Krieger, 1991). The famous sound-bite of René Descartes 'cogito, ergo sum': 'I think, therefore I am', became the starting point for most discourse on the nature of things. This dictum does not advocate idealism. It does not assert that everything is necessarily a construct of the human mind. But it assumes that the world of things and beings is surveyed and interpreted from the point of view of a (...) single individual. Nowhere is this stance more entrenched than in the philosophy of science. To a remarkable degree the scientist is represented as studying the natural world as if alone in it, served only by mindless assistants who might as well be replaced by machines. Scientific theories are presented as systems of thought conjured up and tested by that same individual in a further series of single-headed operations. Research results are formulated and treated philosophically as the independent findings of lone explorers, each reporting the evidence of their own eyes and their rational inferences concerning the hidden mechanisms by which these personal percepts might be generated. Our epistemological role models are Robinson Crusoe and Sherlock Holmes, self-sufficient intellectuals to whom their human companions, Friday and Watson, are mere stooges. (shrink)
